Adventure Pro Outdoors, LLC (APO) River Trips
1299 E. Canal St., Nelsonville, OH 45764 — Participant Waiver & Release of Liability Agreement
In consideration of the services provided by Adventure Pro Outdoors, LLC (APO) River Trips, their officers, agents, stockholders, and all other persons or entities with those businesses (hereinafter referred to as “Lessor”), I, primary renter (Lessee), agree to the following:
Although APO River Trips has taken reasonable steps to provide you with appropriate equipment and information so you can enjoy your activity for which you may not be skilled, we wish to remind you: this is not without risk. It is important for you to know in advance what to expect and to be informed of the inherent risks.
- I have been provided with the appropriate equipment as well as a training upon request by APO River Trips.
- I understand that this type of outdoor activity has inherent risks, dangers, and hazards on and off the water. This includes while in the watercraft or outside of the watercraft. Participation in such activities can result in injury, illness or death including but not limited to the following: bodily injury, disease, infection, partial and/or total paralysis, disability, fractures, death or other serious ailments that could cause serious disability. The risk, dangers and hazards may be by fault of the negligence of Lessor, the negligence of the lessee(s), the negligence of others as well as accidents, breaches of contract, the forces of nature or other causes. Risks and dangers may arise from foreseeable or unforeseeable causes including but not limited to: Lessor decisions dealing with terrain, weather, trail, location, river route, water level; risks of falling out of or drowning while in canoe, kayak, tube, or personal equipment; and other such risks, and any other risks, hazards and dangers that are integral to recreational activities that take place in the wilderness, outdoors, or recreational environment. By participation in these activities and/or use of equipment, I assume all risks, dangers and hazards and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or any other conduct of Lessor or by any other persons.
- By signing, I understand that the description of the risks, dangers and hazards is not complete and that other unknown or unanticipated incidents may result in injury or death. I also agree to assume all responsibility for the risks identified herein and those risks not specifically identified for myself, and any minors listed. I have adequate life, health and disability insurance for all participants. My participation in this is purely voluntary; I am not being forced to participate, and I elect to participate despite the risks. Any minors and I listed elect to participate in spite of risks, dangers, or hazards.
- I also verify that I am in good health, not under the influence of any drugs or alcohol of any kind, nor do I have them in my possession. I understand that Lessor reserves the right to refuse any person it judges to be incapable of meeting participation requirements.
- As a participant in this activity, I agree on my behalf and the behalf of the listed participants that any photograph, video, or medium made during my trip, on the premises, during transport, or at any other time by Lessor or a party of the Lessor are the sole property of Lessor and can/may be used in advertising, promotion or any way Lessor sees fit.
- I agree to not litter.
- I agree to no “Bridging” of any vessel. Bridging can cause major vessel damage or injury. Please ask Lessor staff if you have questions or concerns with bridging.
- I have read, understood, and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representatives, estates, and for all members of my family, including any minor accompanying me, and/or participating in this activity. I acknowledge I am not relying on any oral, written, or visual representatives or statements made by Lessor including those made in its brochures or other promotional material, to induce me to participate in this activity.
By signing this agreement, Lessee understands the following:
- I understand that alcohol is prohibited on Ohio waterways while operating a watercraft and doing so may result in legal action.
- I understand that I will be held liable for damages or loss of any rental equipment, which includes boats, tubes, PFDs, and paddles. Leaving equipment (damaged or in good condition) unattended on the river will result in charges to the credit card on file for a price Lessor sees fit.
- I understand that a late fee of $50 for every half hour will be charged for each boat returning to the livery after the posted time. It is my responsibility to be aware of the posted time.
- I have watched and taken under advisement the paddle sports safety video.
